5. Pricing and Payment Terms
Fingertipps offers two pricing models:
- Commission-Based: A small fee per transaction, ideal for startups with no upfront costs.
- Flat Monthly Subscription: A fixed monthly fee with no transaction fees, for predictable costs.
Pricing details are available at https://fingertipps.com. You are responsible for all fees associated with your account. We may adjust pricing with 30 days' notice via email or website announcement.
All payments are non-refundable unless otherwise stated in our refund policy (see Section 9). You must provide valid payment information for subscription or transaction fees. Failure to pay may result in suspension or termination of your account.
6. Third-Party Services
Fingertipps integrates with third-party services (e.g., payment gateways like Paystack or Flutterwave) to process transactions and provide analytics.
These services are governed by their own terms and privacy policies, which you agree to comply with. We are not responsible for the performance, security, or practices of third-party providers.
7. Intellectual Property
Our Content
All content on Fingertipps (e.g., templates, logos, software, dashboard designs) is owned by Fingertipps Technologies Ltd. or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may use our templates and tools solely for operating your store on our platform. You may not copy, modify, distribute, or reproduce our content without written permission.
Your Content
You retain ownership of content you upload to your store (e.g., product descriptions, images, logos). By uploading, you grant Fingertipps a non-exclusive, worldwide, royalty-free license to use, store, and display your content to provide our services (e.g., hosting your store, processing orders).
You confirm that your content does not infringe on third-party rights.
8. Customer Data
You may collect personal data from your customers (e.g., names, addresses, payment details) through your Fingertipps store. You are solely responsible for:
- Complying with applicable data protection laws (e.g., GDPR, CCPA).
- Obtaining necessary consents from your customers.
- Ensuring the security and lawful use of customer data.
Fingertipps processes customer data on your behalf but does not store full payment information. We are not liable for your handling of customer data.
9. Refunds and Cancellations
- Subscriptions: Monthly subscriptions are non-refundable. You may cancel your subscription at any time, effective at the end of the billing cycle. No pro-rata refunds are provided.
- Commission-Based Plans: Transaction fees are non-refundable.
- Refunds for Issues: If you experience service disruptions due to our error, contact us within 7 days at support@fingertipps.com for review. Refunds, if approved, will be processed within 14 days.
10. Termination
You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your account if you:
- Violate these Terms.
- Fail to pay applicable fees.
- Engage in illegal or harmful activities.
Upon termination, your store will be deactivated, and data may be deleted within 60 days, subject to legal requirements. Sections 7, 11, 12, and 14 survive termination.
11. Limitation of Liability
To the fullest extent permitted by law, Fingertipps Technologies Ltd., its affiliates, and partners are not liable for:
- Indirect, incidental, or consequential damages (e.g., lost profits, data loss).
- Service interruptions due to maintenance, third-party issues, or unforeseen events.
- Losses from your failure to secure your account or comply with these Terms.
Our total liability is limited to the amount you paid us in the 6 months prior to the claim.
12. Indemnification
You agree to indemnify and hold Fingertipps Technologies Ltd., its affiliates, and partners harmless from claims, losses, or damages arising from:
- Your use of the platform.
- Your content or customer data.
- Your violation of these Terms or applicable laws.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Nigeria. Any disputes will be resolved through negotiation in good faith. If unresolved, disputes will be subject to the exclusive jurisdiction of courts in Abuja, Nigeria.
14. Changes to These Terms
We may update these Terms to reflect changes in our services or legal requirements. We'll notify you via email or website notice at least 30 days before changes take effect.
Continued use of Fingertipps after updates constitutes acceptance of the new Terms.
15. Miscellaneous
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the full agreement between you and Fingertipps.
- Severability: If any provision is found invalid, the remaining provisions remain enforceable.
- No Waiver: Our failure to enforce any right does not waive that right.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in case of a merger or acquisition.
